1. Acceptance of these Terms

These Terms of Use ("Terms") form a binding legal agreement between you ("you", "your") and TJ LENDING LLC ("TJ LENDING", "we", "our", "us"). By accessing or using our website at lending-tj.com or any associated mobile application or service we operate (collectively, the "Service"), you agree to be bound by these Terms and by our Privacy Policy and Loan Terms. If you do not agree, do not use the Service.

2. Description of the Service

TJ LENDING is a technology platform and a Texas-licensed Credit Access Business (CAB License #1400050303-154299, NMLS #319848). We operate this website and any associated mobile application to allow eligible users to submit a loan request and have it reviewed by our partner lender. TJ LENDING is not the lender. We do not make credit decisions, issue loans, or determine APR, fees, or repayment terms. The actual loan, when extended, is issued by our partner lender and governed by the loan agreement you sign with that lender, which controls with respect to that specific loan.

3. Eligibility

To use the Service, you must:

• Be at least 18 years of age
• Be a legal resident of the United States
• Have a valid Social Security Number or Individual Taxpayer Identification Number, where required for the requested service
• Have the legal capacity to enter into a binding agreement

By using the Service, you represent and warrant that you satisfy all of the above eligibility criteria.

4. Accuracy of information

You agree to provide accurate, current, and complete information in any application or submission you make through the Service. You are solely responsible for the accuracy of information submitted, and you understand that we and our partner lender rely on that information when reviewing your request. Providing false, misleading, or fraudulent information may result in denial of your application, termination of your account, and may constitute a violation of federal and state law.

5. Permitted use

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own personal, non-commercial purposes, subject to these Terms. All other rights are reserved.

6. Prohibited conduct

You agree not to:

• Use the Service for any unlawful, fraudulent, or deceptive purpose
• Submit information that is not yours or that you are not authorized to share
• Impersonate any person or misrepresent your affiliation with any person or entity
• Attempt to gain unauthorized access to any portion of the Service or related systems
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Use any robot, scraper, or automated means to access the Service without our prior written consent
• Reverse engineer or attempt to derive the source code of any portion of the Service
• Use the Service in any manner that violates these Terms or applicable law

7. Intellectual property

The Service, including its design, layout, text, graphics, logos, code, and underlying technology, is owned by TJ LENDING or its licensors and is protected by intellectual-property laws. Nothing in these Terms grants you any right or license to use any TJ LENDING trademark, trade name, or logo without our prior written consent.

8. Partner lender, services, and links

The Service includes interactions with our partner lender, who issues any loan extended to you. Your interactions with that lender — including review and decision to accept any offer, signing of the loan agreement, and ongoing servicing of the loan — are governed by your loan agreement with the lender and that lender's own policies. TJ LENDING does not control and is not responsible for the lender's underwriting decisions, terms, or actions, nor for the content of any third-party website linked from the Service.

9. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; OR THAT THE SERVICE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT OR MAKE ANY REPRESENTATION REGARDING ANY OFFER, APPROVAL, OR FUNDING DECISION MADE BY OUR PARTNER LENDER.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL TJ LENDING, ITS AFFILIATES, OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OR INABILITY TO USE THE SERVICE; (B) ANY CONDUCT, CONTENT, OR DECISION OF OUR PARTNER LENDER OR ANY OTHER THIRD PARTY ON OR THROUGH THE SERVICE; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

11. Indemnification

You agree to indemnify, defend, and hold harmless TJ LENDING and its affiliates and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of any third party; or (d) any inaccurate or unauthorized information you submit through the Service.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice, including if we believe you have violated these Terms. Upon termination, the provisions of these Terms that by their nature should survive will continue to apply, including Sections 7, 9, 10, 11, 13, and 14.

13. Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Subject to Section 14, any action arising out of or related to these Terms or the Service must be brought exclusively in the state or federal courts located in Harris County, Texas, and you consent to the personal jurisdiction of those courts.

14. Arbitration and class-action waiver

Please read this section carefully — it affects your legal rights.

Except for claims that may be brought in small-claims court, any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will be conducted in Harris County, Texas, in the English language, by a single arbitrator. Judgment on the arbitrator's award may be entered in any court of competent jurisdiction.

YOU AND TJ LENDING AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

You may opt out of this arbitration agreement by sending written notice to seo@lending-tj.com within 30 days of first accepting these Terms. Your notice must include your full name, mailing address, and a clear statement that you wish to opt out of arbitration.

15. Changes to these Terms

We may modify these Terms from time to time. The "Last updated" date at the top of this page reflects when the most recent change took effect. Material changes will be communicated through the Service or by email. Your continued use of the Service after a change constitutes acceptance of the updated Terms.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force and effect.
